Terms and Conditions
1. Operator and Acceptance of Terms
By creating an account, starting checkout, purchasing a paid plan, or using DevMail, you agree to these Terms and our Privacy Policy.
Privacy and data-rights requests are handled through the Privacy Policy and the contact details provided there.
2. Service Purpose
DevMail is a development and testing mailbox service. It is not a consumer email product and is not intended for personal, business-critical, or production inbox usage.
3. Accounts, Eligibility, and Access
You are responsible for your account credentials and activity under your account. Keep your password and API keys secure.
If you create an account on behalf of a company or other organization, you confirm that you are authorized to bind that organization to these Terms.
We may suspend or restrict access for security incidents, abuse prevention, legal compliance, or violations of these Terms.
We may also suspend or permanently delete free accounts that remain inactive for 60 consecutive days. For this purpose, inactivity means no successful login and no API-key use during that period.
If we delete an inactive free account, access to the account, generated inbox identity, stored mailbox content, and API-key records may be removed. We may try to notify you before deletion, but advance notice is not guaranteed.
4. Prohibited and Unsafe Usage
Do not use this service to receive, store, or process:
- Sensitive personal data.
- Confidential, proprietary, or regulated information.
- Production user communications.
- Third-party personal or production data unless you are authorized to use it and doing so is lawful.
- Usage of DevMail for illegal activity is strictly prohibited.
- Any content or activity that violates applicable laws.
- Spam, phishing, malware distribution, or abusive automation.
- Paid products that are primarily a wrapper around DevMail.
- Mirror or proxy services that expose DevMail APIs under a different domain or brand.
5. Data, Content, and Retention
You are responsible for content sent to or received by your generated inboxes.
Stored email content and attachments are encrypted at rest as part of our technical and organizational security measures. This helps us protect personal data and strengthen the security of the service.
Email data may be deleted by retention rules, security controls, abuse handling, account actions, or operational maintenance. Do not treat DevMail as durable storage.
Our handling of personal data is described in the Privacy Policy.
6. Plans, Checkout, and Recurring Billing
DevMail may offer Free and Pro plans. Current features and pricing are shown on the Pricing page and may change prospectively.
Pro checkout and recurring billing are processed by Polar. By purchasing Pro, you also agree to applicable Polar checkout and payment terms presented at checkout.
Unless stated otherwise at checkout, Pro is billed as a recurring monthly subscription in the currency shown at checkout and renews automatically until canceled.
Plan upgrades or downgrades are applied after confirmed billing events (for example, webhook confirmation). In some cases, there may be a short processing delay.
Subscription renewals, taxes, invoices, payment methods, and refunds are handled through the billing provider workflow. We do not store your full payment card details.
7. Cancellation and Refunds
To stop future renewal charges, cancel your subscription through the billing provider flow (for example, customer portal or billing email links) or contact us.
Unless required by applicable law, fees are non-refundable for the current billing period after a charge is processed.
Cancellation stops future renewal charges but does not automatically create a prorated refund for the active billing period unless required by law or expressly stated otherwise.
If you request account deletion from the Danger Zone while Pro is active, we first attempt to cancel the subscription. If cancellation cannot be confirmed, account deletion is blocked to help avoid accidental continued billing.
Consumers may have mandatory cancellation, withdrawal, or refund rights under applicable law. Nothing in these Terms limits those non-waivable rights.
8. Availability, Support, and Service Changes
We may modify, suspend, or discontinue any part of the Service at any time, including features, limits, or plan structure.
Unless separately promised in writing, DevMail does not provide a service level agreement, guaranteed uptime, guaranteed error-free operation, or guaranteed support response times.
9. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim warranties of availability, uninterrupted operation, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the maximum extent permitted by law, DevMail is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill.
To the maximum extent permitted by law, our total liability for claims related to the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim.
Nothing in these Terms excludes or limits liability where exclusion is prohibited by applicable mandatory law.
11. Suspension and Termination
You may stop using DevMail at any time. We may suspend or terminate access if required for security, abuse prevention, legal compliance, non-payment, or Terms violations.
Suspension or termination may result in loss of access to stored mailbox content and paid features, subject to applicable law.
12. Consumer Rights
If you are a consumer, you may have mandatory rights under the law of your country of residence. These Terms apply only to the extent they do not override those non-waivable rights.
Where a statutory right of withdrawal applies to a paid digital service purchase, that right and any exceptions or waivers will be governed by the information presented at checkout and the applicable mandatory law.
13. Governing Law and Venue
These Terms are governed by Polish law, excluding conflict-of-law rules, unless mandatory law requires otherwise.
If you are a consumer, mandatory law may allow you to bring claims in your place of residence or rely on local consumer protections.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date shown above.
15. Contact
Legal, billing, and Terms-related questions: [email protected]
For privacy and data-rights requests, use the contact details listed on the Privacy Policy.
16. General Legal Terms
If any provision of these Terms is held unenforceable, the remaining provisions remain in effect.
These Terms do not limit any non-waivable rights you may have under applicable consumer protection law.
Our failure to enforce any provision immediately is not a waiver of that provision.
